1. Agreement to Terms

By accessing or using Intellivue ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Intellivue provides a quality assurance platform that includes automated testing, analytics, security checks, and compliance monitoring tools. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

  • Maintaining the security of your account and password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your account information is accurate and up-to-date

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit malicious code or malware
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use the Service for any illegal or unauthorized purpose

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Intellivue and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6. Payment Terms

If you purchase a paid subscription:

  • Fees are billed in advance on a monthly or annual basis
  • Payment is non-refundable except as required by law
  • We reserve the right to change pricing with 30 days notice
  • Failure to pay may result in service termination

7. Repository Access and Data Processing

By using our Service, you acknowledge and agree that:

  • We may connect to your GitHub repositories to access metadata, file structures, and coverage data
  • We process your test coverage data, runtime metrics, and performance analytics to provide insights and recommendations
  • We may use AI and machine learning technologies, including Cloudflare Workers AI, to analyze your coverage data, runtime data, and code patterns to improve our Service and provide intelligent recommendations. When using Cloudflare Workers AI: (1) you own all inputs and outputs, (2) your data is not shared with other customers, (3) your data is not used to train AI models without your explicit consent.   • We do not store your source code. Source code is accessed temporarily for analysis purposes only and is not persisted in our systems
  • Coverage reports, runtime metrics, and analytical data generated from your repositories are stored to provide historical trends and insights
  • You retain all ownership rights to your repositories, code, and data. We only access what is necessary to provide the Service

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect, use, and protect your data as described in our Privacy Policy. You retain ownership of any data you submit to the Service.

9. Service Availability

We strive to maintain high availability but do not guarantee that the Service will be uninterrupted or error-free. We reserve the right to suspend the Service for maintenance or updates.

10. Limitation of Liability

To the maximum extent permitted by law, Intellivue shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Intellivue operates, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
